What is Marketplace Optimization?

Email/Push Campaigns

The CommerceRack Campaign feature enables businesses to communicate to customers via email and app-push. Once customers have migrated to app-push a business can leverage so many exciting benefits (including guaranteed delivery).

Times are Changing

Email is certainly showing it's age. For promotional messages both placement and effectiveness rates are falling thanks to daily blasts from companies like Groupon and LivingSocial. Young adults are using email less and less and replacing it with social networks like Facebook or Twitter which use their own applications with app-push. CommerceRack includes the first CRM Database which allows customers to choose between email, and app-push. Businesses should view this as nothing more than a natural evolution of the historical "text or html email" question that was routinely asked between 1995 and 2005. If a customer has installed an app we will automatically flag them for app push, and if the native app is uninstalled they can be converted back to email.

SMS vs. App Push

It is very common for app push to be confused with short message service (SMS). SMS or "Texting" is a receiver pays per message service offered by most cellular services which is limited to around 150 characters per message. App Push is sender pays reliable transport offered by mobile platforms such as Android (GCM), Apple IOS (APNS), and Amazon Kindle (ADM). Unlike SMS which is sent to a telephone number, an App push is sent directly to an application subscriber id that was created when the app was installed. The size and capabilities of app push vary by operating system, but since messages are actually sent to the receiving application it can include instructions to download any amount of content. SMS can contain multimedia audio or video as attachments only, whereas App Push is only limited by the device and could even contain two way video, audio, location or more.

EMAIL vs. App Push

There are several well known issues businesses face when communicating with email which demonstrates why app-push could eventually replace email.

  • Spam Filters: the original design of email has no way to authenticate legitimacy of senders, so complicated filters effectively "guess" the nature of messages. With app push the consent is implicit with the install of the application and so no such filters exist.
  • Email Formatting: email was originally designed for text on dumb terminals, and pre-dates html/web by almost 20 years. due to some early design limitations and incompatibilities it is not possible to use modern html5, css3, and javascript. It is generally understood with email it is possible to embed graphics, but it is generally not possible to leverage the easier and more powerful features of html5 and css. App-push is not subject to these limitations, it can display both email messages and also the enhanced messages.
  • List Maintenance: due to incompatibilities in email/smtp clients there is not a reliable way to detect if a message was delivered. ESP's require email marketers to perform regular list maintenance and expire emails that have not been confirmed. App-push does not have these restrictions, as long as the app is installed on the device it will be able to receive notifications (unless the device owner explicitly disallows notifications for the app).

CommerceRack Wholesale allows suppliers to create and then assign an unlimited number of pricing schedules to customers. Based on the quantity of products that are purchased, manufacturers can provide automated discounts on unit pricing or shipping. Wholesalers can offer free shipping or other promotions based on the qualifications set for each pricing schedule. While additionally operating a B2C stor e, e-commerce sites can offer completely different pricing, shipping and promotions for purchases associated with each pricing schedule.

Easy to Maintain

Schedules can be updated using formulas that derive from MSRP or unit costs. So updating the cost of a product updates all schedules, and schedules have a default pricing formula for all products. CommerceRack also can adjust or override the default pricing for any item through custom pricing or custom pricing formulas that can be specified for each schedule on each product. Affiliate/Intranet Sites

The ability to operate multiple affiliate and/or Intranet sites allows online businesses to have both a regular (B2C) website and a wholesale (B2B) website with the same products and a shared inventory but different pricing. The additional sites may have their own unique domain, or be hosted on any blog, forum, or Intranet which allows embedded HTML and/or Javascript. Best Practices for SEO

SEO for apps can be a bit challenging. Fortunately all major search engines including Google, Bing, Yandex, and Baidu all support the Google Escaped Fragment best practices. CommerceRack uses a technology called "SEOng" to create Static escaped fragments, along with sitemaps. This effectively"dumps" the site into a search engine friendly format. Back buttons and canonical urls are integrated into all examples. Finally W3C RDFa for HTML5 is also embedded into the application itself.

Embedding into Content Platforms

Google and other search engines prefer a site with substantial content. Google will crawl audio, video, and text to make determinations about the content for a related search. Signals such as writing style and site layout (blog, forum, etc.) will be evaluated and contribute to the final result. Content platforms like Joomla and Wordpress are known for their search-ability, but also their dismal security records. By attaching a browser app onto a shopping platform a site can benefit from the ease of content publishing. Additionally sites like Wordpress which can export RSS/ATOM/JSON formatted content can be used as content/publishing repositories for both native and mobile apps.

Checkout Redirect allows any existing e-commerce website to have it's checkout, order, and customer management functions migrated into the cloud. The anyCommerce SDK includes a checkout redirect script for Magento which can "hijack" the add to cart, shopping cart, and login/customer management capabilities. Direct Data Transfer

This is fast, prevents duplicate orders and allows multiple users to log in simultaneously. By contrast, the third-party connectors used by many CommerceRack competitors aren’t QuickBooks Certified Gold Developers, so their integration generally comes from an input file that only provides a one-way transmission. Windows Desktop Client

The desktop application for Windows duplicates many of the functions available via the web interface. The windows desktop is especially useful for people with slow Internet connections or who need access to synchronize with other desktop software like Endicia Dazzle or Quickbooks. We are currently working on adding these capabilities to the web-based version but in the meantime we have a desktop client.

How it works

Once an order is created, or imported a copy is automatically downloaded into the Order Manager Desktop so the fulfillment workflow can begin. Any changes, edits, or tracking that are added to the order are automatically uploaded to the website and the customer is notified via an email with no employee interaction.

Batch Order Processing

The ability to easily assign orders into batches for employee processing is a technique that is considered to be the most efficient and scalable deployment of resources in an organization. When combined with the advanced filtering feature it's easy to understand how much efficiency this technique can bring to both customer service / warehouse operations.

CommerceRack's advanced filtering makes it easy to identify and process batches of orders. For example a common filter used during the holidays – could identify new orders, that are paid, with no fraud hold, with one item, where the customer requested expedited shipping. Layered Search lets shoppers filter by multiple attributes on a search is rapidly becoming the defacto way to find products.   • Why is it free - whats the catch?

    MIT license is one of the most permissive licenses available - so yes, it's really free. If you want to be able to call us then we recommend you sign up for the Complete program.

    The software is free for you to do what you want with it. We couldn't have built this software without the help and support of thousands of other developers who built software like Linux, Nginx, Uwsgi, Perl, Java, ElasticSearch, MySQL, Redis, Apache Lucene, Memcache, cpan, github.com and literally hundreds of other libraries, and shell utilities.

  • How do you make money if it's free?

    First, we're a very lean company - we have no offices, all our staff work remotely around the world. Second, a lot of clients purchase our Complete service package, and we also do specialized consulting for projects. Some partners who want to be part of this framework provide a revenue share with us.

  • If I self-deploy, can I add the Complete service later?

    Yes, however the provisioning fee applies each time you add/remove a service, and of course some restrictions apply. Specifically the server(s) need to comply with our general configuration guidelines - which are pretty flexible.

  • Can I get the complete service and then migrate to self hosted?

    Yes, however you would need to obtain your own API licenses since you will not longer be a client of ours (which is the only way we are allowed to let you use our licenses). Obviously it's a cloud instance you control so you could simply lock us out and keep the license file. We rotate keys annually so be prepared when it magically stops working one day (without notice) if you don't obtain your own licenses.

  • Where can I obtain these licenses?

    Developer Licenses are required for connecting to third party API's like UPS, FedEx, Amazon, eBay, etc. The purpose behind a developer license is identify the maker of a particular piece of software so that an API provider can identify who is making particular calls and consuming resources.

    Each provider has a different licensing process. Check the source files for documentation.

    In some cases it may not be possible to obtain your own license (they may only be available to providers).

  • How can I get help with my free version?

    Hire a developer/consultant, or ask on expert-exchange.

Once you receive an IP address from the infrastructure provider for your server you should access https://ipaddress:9000/.
If you experience difficulties:
  • First check the IP address or domain.
  • Make sure you are using a public ip address. Addresses that begin with 192.168., 172.16, or 10. are not public.
  • Make sure there are no firewall rules, and the server has a public route configured.
  • Contact your service provider and ask them why they didn't set this up for you (or find a different service provider).

Company History

CommerceRack and anyCommerce started out as concepts in 2009 by the developers of CommerceRack, a privately held small business e-commerce website hosting and marketplace management company with 13 years of expertise in e-commerce. CommerceRack is a cloud service infrastructure that enables transactional commerce. CommerceRack utilizes anyCommerce's open-source framework to create unified experiences for e-commerce, m-commerce, social commerce and retail/brick and mortar businesses.

By 2011, most browsers on the market were releasing versions which could run the anyCommerce technology, and cloud services were rapidly growing in both popularity and stability. Recognizing the size and scope of this opportunity led to a decision by CommerceRack's management team to spend six months focusing on a prototype which was completed in early 2012.

After numerous unforeseen delays and failed light-bulb experiments, the decision to stop boarding new clients and focus all energies toward developing exclusively for the cloud was made as it proved to be the best way to pursue the company's long term revenue goals. An end of life sunset date for SAAS hosted sites was announced and all resources were channeled into cloud products. The CommerceRack system was migrated to the new anyCommerce technology and the CommerceRack project was unveiled in Q1 of 2014.

1. ACCEPTANCE OF TERMS

Welcome to CommerceRack. CommerceRack provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you.

In addition, when using particular CommerceRack services, you and CommerceRack shall be subject to any posted guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS.

2. DESCRIPTION OF SERVICE

CommerceRack currently provides users with access to a rich collection of on-line resources, including, various communications tools, software, online forums, shopping services, personalized content and branded programming through its network of properties (the "Service"). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new CommerceRack properties, shall be subject to the TOS.

You understand and agree that the Service is provided "AS-IS" and that CommerceRack assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any communications or data unless explicitly stated elsewhere.

In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. You must be at least 18 years of age to access and use CommerceRack services.

3. YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself and your company as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or CommerceRack has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CommerceRack has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). CommerceRack is not liable for any resulting loss of service due to untruthful or incomplete information.

CommerceRack is concerned about the safety and privacy of all its users, particularly minors. For this reason, parents, or the legal guardian of minors who wish to allow their children access to CommerceRack must agree to supervise, and otherwise completely indemnify CommerceRack of any content the minor may come into contact with during operation of the CommerceRack service. Please remember that the Service is designed to appeal to a mature business audience. Accordingly, as the legal guardian, it is your responsibility to determine whether any of the Services and/or Content (as defined in Section 6 below) are appropriate for your child.

4. COMMERCERACK PRIVACY POLICY

5. MEMBER ACCOUNT, PASSWORD AND SECURITY

You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to: (a) immediately notify CommerceRack of any unauthorized use of your password or account or any other breach of security. (b) ensure that you exit from your account at the end of each session.

CommerceRack cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 5. Furthermore CommerceRack is not responsible for any damages, which may occur to you, your community standing, or your business in the event of a known or unknown person(s) gain unauthorized access to your account.

6. MEMBER CONDUCT

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not CommerceRack, are entirely responsible for all Content that you upload, post, email or otherwise transmit via the Service. CommerceRack does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will CommerceRack be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service.

You agree to not use the Service to:

  1. Upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable
  2. Harm minors in any way
  3. Impersonate any person or entity,; including, but not limited to, a CommerceRack official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity
  4. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service
  5. Upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements)
  6. Upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party
  7. Upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose
  8. Upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or that may interfere with or disrupt the normal flow and operation of any system.
  9. Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service
  10. Intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated be the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law
  11. "Stalk" or otherwise harass another individual
  12. Collect or store personal data about other users of this service

You acknowledge that CommerceRack does not pre-screen Content, but that CommerceRack and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, CommerceRack and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by CommerceRack or submitted to CommerceRack, including without limitation information in CommerceRack and in all parts of the Service.

You acknowledge and agree that CommerceRack may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:

    (a) comply with legal process;
    (b) enforce the TOS;
    (c) respond to claims that any Content violates the rights of third-parties;
    (d) protect the rights, property, or personal safety of CommerceRack, its users and the public.

You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

7. SPECIAL ADMONITIONS FOR INTERNATIONAL USE

Recognizing the global nature of the Internet, you agree to comply with all local rules in your jurisdiction regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from or to the United States or the country in which you reside.

8. INDEMNITY

You agree to indemnify and hold CommerceRack, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

9. NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

10. GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that CommerceRack may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, maximum sizes of images, total number of products, sales history, or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on CommerceRack's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that CommerceRack has no responsibility or liability for the deletion or failure to store any communications or other Content maintained or transmitted by the Service. You acknowledge that CommerceRack reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that CommerceRack reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

11. MODIFICATIONS TO SERVICE

CommerceRack reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that CommerceRack shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

12. TERMINATION

You agree that CommerceRack, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if CommerceRack believes that you have violated or acted inconsistently with the letter or spirit of the TOS. CommerceRack may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that CommerceRack may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that CommerceRack shall not be liable to you or any third-party for any termination of your access to the Service.

13. DEALINGS WITH ADVERTISERS

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that CommerceRack shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

14. LINKS

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because CommerceRack has no control over such sites and resources, you acknowledge and agree that CommerceRack is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that CommerceRack shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

15. COMMERCERACK'S PROPRIETARY RIGHTS

You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") may contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by CommerceRack or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

CommerceRack grants you a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by CommerceRack for use in accessing the Service, or by through interfaces which have been appropriately licensed and endorsed by CommerceRack, Inc.

16. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. COMMERCERACK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
  2. COMMERCERACK MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

18. INDEMNIFICATION OF ILLEGAL ACTIONS

By using CommerceRack services you represent that the goods or services you promote on CommerceRack belong to you, and that such items were obtained legally, through sanctioned reputable channels, and that such goods or services are legal in your jurisdiction, and that you have the authorization by all necessary government or regulatory boards to sell, issue, authorize, or otherwise transfer said goods and services. Furthermore you represent that you will take all necessary measures to insure said goods or services do not reach areas, or individuals who are not allowed to own, handle, or otherwise poses such goods or services. Furthermore you represent you will take reasonable steps to insure that said goods or services do not transit an area where said goods and services are illegal or prohibited, unless explicitly allowed through other applicable laws such as in the case of interstate commerce. And that in the case of dangerous goods, all necessary preparations were made to avoid any accidental release, leakage, discharge, or other action which may expose persons responsible for shipping, transporting, or receiving goods any harm. 22. UNLIMITED TRAFFIC POLICY

We are pleased to offer our clients unlimited Web page traffic. To maintain the integrity of our service the following limitations apply:

  • Sites which offer offsite links to purchase products/services which are considered "non-trackable" sales.
  • Sites which attempt to circumvent CommerceRack's ability to record and track sales.
  • Sites housing multiple directories with unrelated information not directly related to the sale of a product.
  • Multiple hosts resolving at an ip or domain name that we provide.
  • Sites with Banners, graphics or cgi's running from their domain used on other domains.
  • Sites with large graphic archives or galleries (non-product related)
  • Sites offering downloads or archives, such as .mp3, .wmf, .avi, .zip, .tar, .ra and .GZ.
  • Sites using more than 5% of system resources
  • For those that do not qualify for the unlimited service, will be invoiced at a rate of $50 gigabyte. with a minimum of 2 gigabytes of traffic.
CommerceRack will be the sole arbiter as to what constitutes a violation of this provision.

23. SEARCH ENGINE POLICY

CommerceRack test sites are all hosted under the "COMMERCERACK.COM" domain name, and using IP addresses assigned to CommerceRack by the American Registry for Internet Numbers (ARIN). Some search engines may not distinquish that each site is separate and therefore the actions of one customer, can affect all customers. For this reason CommerceRack has developed a strict policy regarding Search Engine "Spamming" techniques. Customers are explicitly prohibited from:

  • Cloaking - creating deceptive pages which attempt to trick search engines into giving higher ranking.
  • Writing text or creating links that can be seen by search engines but not by visitors.
  • Participating in link exchanges for the sole purpose of increasing your ranking in search engines.
  • Sending automated queries to Google in an attempt to monitor your site's ranking.
  • Use programs that generate lots of generic doorway pages.

25. GENERAL INFORMATION

The TOS constitute the entire agreement between you and CommerceRack and govern your use of the Service, superceding any prior agreements between you and CommerceRack. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. The TOS and the relationship between you and CommerceRack shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and CommerceRack agree to submit to the personal and exclusive jurisdiction of the courts located within the county of San Diego, California. The failure of CommerceRack to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

27. POLICIES

CommerceRack has developed documented policies to describe how we will handle and ultimately resolve a variety of situations which may occur regarding topics such as (but not limited to) billing, customer service, system outages, site modifications, and third-party integrations. Any usage of the CommerceRack.com website is considered receiving service from CommerceRack and therefore, when applicable, is subject to those policies.

28. TERMINATION (CANCELLING SERVICES)

Usage of this service constitutes acceptance of the CommerceRack Cancellation Policy in order to terminate this service. Cancellations must be done via the online interface and will be effective until the end of the billing cycle.

29. LIMITATION OF DAMAGES

Under no circumstances shall any court award damages exceeding the actual amount invoiced [if by CommerceRack], or paid [if by client], plus $1.00.

30. BINDING ARBITRATION

In the event a dispute arises between two parties that are subject to this Terms of Service, it is hereby agreed that both parties will submit to mediation, and failing an acceptable result, both parties shall submit to binding arbitration. All mediation and arbitration shall be performed in the County of San Diego, State of California and either party may choose to electronically attend.

The mediation and arbitration shall be conducted in accordance with the applicable United States Arbitration and Mediation Rules of Arbitration. The arbitrator's decision shall be final and legally binding and judgment may be entered thereon.

Each party shall be responsible for its share of the mediation, and arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award.

Getting Started with CommerceRack

The Cloud includes a lot of choices, in most cases if the right choice isn't immediately obvious, then it's probably safe to assume all the choices are approximately the same.

  1. Select Instance/License Type: Public Cloud, Private Cloud, or SAAS.
  2. Select Instance+License: The License Type will determine which infrastructure providers will be appropriate, and the costs.
  3. Select a Service Provider: Companies which lack in-house skills will want to retain one or more companies with technical expertise to assist in deployment, and ongoing maintenance.
  4. Deploy: Install and configure the commerceRack software, run through the setup tutorial.

In-App Ticketing

CommerceRack offers an online ticketing which can be accessed automatically by clicking the “Support” link in the header of any page in the user interface. After hours “emergency only” support is available through the online ticketing system by creating a high-priority ticket you will page an on-call engineer after normal business hours.

Prepaid Live Help

Each month a certain number of issues are attached to an account. Each account may have one or more Live Help banks of time. Each CommerceRack account receives 1 hour per month of prepaid live help which expires every 60 days. Best Partner Practice (BPP) participants receive an extra hour for every $100 they spend in either custom design, or monthly fees which expire every 60 days. Recent support charges and available balance is available via the support website. Customers who exceed their prepaid time budget are automatically billed on their next invoice. Implementation Assistance For getting your site up and running initially, and in the future prior to any major configuration changes, we highly recommend you schedule an appointment with the Implementation Assistance team. Implementation Assistance appointments may be scheduled through the support website. Confirmed next-day appointments, and unconfirmed same-day appointments are both available on a first come first serve basis. Phone Based Support During our normal business hours you may directly access our support staff by dialing 877-236-0799. Support hours change seasonally and are always posted at the online customer support website. All questions which are under 15 minutes are free, and beyond that your pre-paid time will be allocated.

The CommerceRack Newsletter contains a variety of information and most importantly gives insight and detail into upcoming changes. New accounts are automatically subscribed to the CommerceRack Newsletter which is sent out on Friday every other week.

Billing

You may add/remove features to your account, review your billing history, and update payment information. The CommerceRack billing department may be reached by emailing billing@commercerack.com. All requests for changes to accounts must either be in writing, or originate from the email address of the billing contact.
